Our terms of service outline the rules and guidelines for using POSable. We believe in clear, fair, and transparent terms.
Terms of Service
Last updated: 13 October 2026
These Terms of Service ("Terms") govern your business subscription to POSable, our cloud point of sale software. Please read them carefully before you use the Service.
In short:
- POSable is for businesses only. POSable Ltd contracts with UK customers and POSable LLC contracts with US customers.
- Plans are paid in advance, monthly or yearly, and renew automatically until you cancel in your dashboard. There is no setup fee and no long-term contract.
- Once a paid period has started, it is not refundable, in the UK and the US. Cancelling stops the next renewal.
- Card payments are provided by independent payment providers under their own terms. POSable is not a party to card processing.
- UK customers: English law and courts. US customers: Wyoming law and individual arbitration (section 22).
- You own your data. We process it for you, as described in our Privacy Policy.
1. About these Terms and who you contract with
1.1 The agreement. These Terms are a legally binding agreement between the POSable company named in section 1.2 ("POSable", "we", "us", "our") and the business that subscribes ("you", "your"). By registering for, starting a trial of, or using the Service, you confirm that:
- you have read and agree to these Terms
- you have authority to accept them on behalf of your business
If you do not agree, you must not register for or use the Service.
1.2 Your contracting company. The company you contract with depends on where your business is based:
- United Kingdom: POSable Ltd, a company registered in England and Wales (Company Registration Number 16705417), registered office 5 Beach Road, Perranporth, Cornwall, TR6 0JL, United Kingdom.
- United States: POSable LLC, a Wyoming limited liability company, 30 Gould St, Ste N, Sheridan, WY 82801, USA, which contracts with and bills US customers.
1.3 The Service. The "Service" means:
- the POSable cloud web dashboard
- the Android and Windows till apps
- the Shop Floor app and the customer loyalty app
- APIs, AI.MEE features, documentation and related support
1.4 Other documents. These Terms incorporate:
- our Privacy Policy
- our Cookie Policy
- our Data Processing Agreement, which is incorporated into these Terms by reference (see section 13)
If these Terms and any other document conflict, these Terms prevail, except that the Data Processing Agreement prevails on data protection matters.
2. Business use only
2.1 POSable is a business-to-business service. It is for businesses, organisations, sole traders, partnerships, charities, public bodies and other entities acting in the course of a trade, business, craft or profession.
2.2 By creating an account, starting a trial or buying a subscription, you confirm that you are acting wholly or mainly for business purposes and not as a consumer. If you are acting as a consumer, you are not authorised to subscribe to or use the Service.
3. Eligibility and your account
3.1 Age and capacity. You must be at least 18 years old (or the age of majority where you live, if higher) and have legal capacity to enter into contracts. Accounts must be registered by a person, not a bot or automated system.
3.2 Payment authority. You must own, or be authorised to use, the payment method you provide, and have authority to commit your business financially.
3.3 Accurate information. You must give accurate, current and complete information and keep it up to date. False identities and impersonation are prohibited.
3.4 Prohibited registrations. The following are not allowed:
- automated registrations (bots, scripts and the like)
- multiple registrations to obtain more than one free trial
- fraudulent or stolen payment details
- registrations on behalf of suspended or terminated accounts
3.5 Security. You must keep your login details confidential, and you are responsible for all activity under your account. You control user permissions for your staff. Tell us immediately if you suspect unauthorised access, and cooperate with any investigation.
3.6 No transfer or resale. Your account, subscription and licences are personal to your business. You may not transfer, resell, sublicense or assign them to anyone else. You may change the billing contact within your own business.
4. Plans, prices and billing
4.1 Plans. We offer monthly and yearly plans that give access to the POSable platform, as described on our pricing page. Current prices are:
| Plan | Devices | UK (GBP) | US (USD) |
|---|---|---|---|
| Plan 1 Core | Up to 5 POS devices | £20 a month or £200 a year | $29 a month or $290 a year |
| Plan 2 Core | Up to 10 POS devices | £35 a month or £350 a year | $49 a month or $490 a year |
| Plan 3 AI | Up to 5 POS devices | £35 a month or £350 a year | $49 a month or $490 a year |
| Plan 4 AI | Up to 10 POS devices | £45 a month or £450 a year | $65 a month or $650 a year |
There is no setup fee. Each plan is a flat fee for its device allowance, not a charge per till. The website shows exactly what each plan includes.
4.2 Currency and billing company.
- UK customers: billed by POSable Ltd in pounds sterling through Stripe (UK).
- US customers: billed by POSable LLC in fixed US dollar prices through Stripe (US). US prices are set in dollars and do not change with exchange rates.
4.3 Taxes.
- UK: prices exclude VAT, which is added at the applicable rate.
- US: prices exclude sales tax, which is added where applicable.
4.4 Payment in advance and renewal. Fees are payable in advance for each billing period. Plans renew automatically at the end of each period, monthly or yearly, until you cancel under section 6.
4.5 Payment methods. We accept the payment methods shown at checkout when you subscribe.
4.6 Price changes. We may change prices with at least 30 days' notice. New prices apply from your next billing period. If you continue to use the Service after the change takes effect, you accept the new price.
4.7 Billing disputes. You must report billing disputes within 30 days of the charge. We will investigate genuine disputes in good faith.
4.8 Changing plans. You can upgrade or downgrade your plan in your dashboard. Any price difference is applied as shown in your dashboard when you make the change.
4.9 Devices. You can add, remove and replace the devices linked to your account in Device Management, up to your plan's device allowance.
4.10 Failed payments. If a payment fails, we may suspend the Service until it is paid (see section 15).
5. Free trial
5.1 New customers can try POSable free for 15 days. We may change or withdraw the trial offer for future sign-ups.
5.2 One trial is allowed per person and per business. Trials:
- are provided "as is", without warranties
- cannot be extended, refunded or compensated
- come with support on a best-effort basis
5.3 Unless you cancel before the trial ends, your chosen plan starts automatically and your first payment is taken.
5.4 Opening multiple accounts to get extra trials is prohibited. If we find this, we may immediately bill you at the current monthly rate, suspend your account, and hold you liable for the subscription fees.
6. Cancellation, renewal and refunds
6.1 No contract, cancel anytime. There is no minimum contract beyond the billing period you have paid for. You can cancel at any time.
6.2 How to cancel. Cancel in your dashboard: Account Dashboard → Billing → Cancel Subscription. This is the only accepted method. Requests by email, phone, social media, chat or post do not stop billing.
6.3 Monthly plans. Cancelling stops the next monthly renewal. You keep access until the end of the month you have paid for.
6.4 Yearly plans. A yearly plan is a fixed 12-month term. Cancelling stops the automatic renewal at the end of the term. It does not end the current term, and you keep access until the term expires.
6.5 Refunds. This applies to UK and US customers alike. You can evaluate the Service during the free trial, so subscription fees are non-refundable once a paid period has started. We do not give full, partial or pro-rata refunds, or credits for unused time, and cancelling does not create any right to a refund.
6.6 Goodwill. In exceptional circumstances we may, at our sole discretion, give a goodwill refund. Doing so does not create an obligation or precedent.
6.7 Your legal rights. Nothing in this section limits any rights that cannot lawfully be excluded.
7. Card payments and payment providers
7.1 Independent providers. POSable is software. It is not a payment processor, acquirer, bank or money transmitter, and it is not a party to card processing. Card payments are provided by independent payment providers that you choose and contract with directly:
- UK: Dojo, Teya or myPOS
- US: Gravity Payments, using its Emergepay platform
7.2 Between you and your provider. Your card processing is solely between you and your payment provider, under that provider's own terms, fees, approval process, settlement, chargeback rules and privacy policy. This covers:
- payment authorisations and declines
- settlements and payouts
- chargebacks and disputes
- processing fees and rates
- holds, reserves or freezes on funds
- card terminals: their supply, set-up, faults, repair and replacement
- provider outages
You agree your rates directly with the provider. POSable adds no markup to card fees. Any rates shown on our website are indicative only and are set by the provider.
7.3 No POSable liability for card processing. To the fullest extent the law allows, POSable has no responsibility or liability for any of the matters in section 7.2, or for any act or omission of your payment provider. You must raise those matters with your provider.
7.4 What the software does. POSable sends the payment amount to your connected terminal and records the result it receives. The Service works with one card provider at a time, chosen in your settings. Availability depends on your country and the provider's own approval.
7.5 Commercial arrangements. POSable may receive a commercial benefit, such as a revenue share, from some payment providers.
8. Hardware
8.1 POSable does not currently sell hardware. You use your own compatible devices: Android tablets (Android 10 or later, 10-inch screen or larger) or Windows devices, with compatible receipt printers, barcode scanners and cash drawers. POSable does not tie you to a hardware contract.
8.2 Card terminals are supplied by your payment provider, which is responsible for them (see section 7).
8.3 Hardware you buy elsewhere is covered by the seller's and manufacturer's own terms, warranty and returns policy. Any compatibility guidance we give is advice only. Please check compatibility before you buy.
8.4 If POSable offers hardware in future, it will be sold under separate terms.
9. Using the Service
9.1 Offline mode. The till apps are designed to keep working when the internet connection drops. Sales are stored on the device and sync when the connection returns.
- Card payments while offline depend on your terminal and provider. Some terminals, such as the Dojo GO MAX and Teya Pro, need a connection to take card payments.
- Data recorded offline is held only on that device until it syncs. Keep devices secure and reconnect regularly.
9.2 Languages. The dashboard and apps are available in 27 languages. These Terms and our support are in English. Any translation is for convenience only, and the English version prevails.
9.3 Hosting. Your business data is hosted on our regional servers:
- UK: Manchester, Glasgow, Coventry and London
- US: Los Angeles, New York, Chicago, Richmond, Spokane and Las Vegas
Some central services run on our UK server. See our Privacy Policy for details and the safeguards we use.
9.4 Updates. We may release updates, change or remove features, and change technical requirements at any time. Updates are covered by these Terms. We do not have to keep any particular feature, although we will try to give notice of significant changes.
9.5 Availability. We work to keep the Service available and reliable, but it is provided "as is" and "as available". We do not offer a guaranteed uptime or service level unless agreed in writing.
- The Service relies on third parties, such as internet providers, data centres, cloud platforms, payment providers and APIs.
- Disruptions can be caused by connectivity problems, outages, attacks, hardware failures, maintenance, software faults or events beyond our control.
- We may carry out maintenance with or without notice, and will try to schedule it outside peak trading hours.
9.6 Your backups. You are responsible for keeping suitable backups, exports and fallback arrangements for business-critical operations.
9.7 Support. Support is available through the channels published on our website, during these hours:
- UK: Monday to Saturday, 8am to 6pm UK time
- US: Monday to Saturday, 8am to 6pm US Eastern and Pacific time, as published on our website
Hours may change, and the current hours are shown on our website. Support covers:
- account and billing help
- feature guidance
- troubleshooting and incident reporting
It does not cover:
- custom development
- third-party software training
- problems caused by your own hardware or connectivity
- data recovery
We aim to respond promptly, but we do not guarantee response or resolution times.
10. AI.MEE features
10.1 AI plans include AI.MEE features, such as AI business reports, demand forecasting and AI menu boards. These features use third-party AI providers, as described in our Privacy Policy.
10.2 AI outputs are generated automatically and may be inaccurate, incomplete or out of date. Forecasts are estimates, not guarantees. You must review AI outputs before relying on them, especially for pricing, stock, staffing, allergen or other compliance information. You remain responsible for decisions you make using them.
10.3 You must not use AI.MEE to create unlawful, misleading or infringing content.
11. Acceptable use
You must not, and must not allow anyone else to:
- use the Service for anything illegal, fraudulent or harmful, or in breach of sanctions or export laws
- upload content that is unlawful, infringing, malicious, or violates privacy or other rights
- reverse engineer, decompile, copy, rent, sublicense or distribute the Service, or remove proprietary notices, except as the law allows
- disable, bypass or tamper with licensing, device limits or security measures
- use the Service on more devices than your plan allows, or after your subscription ends
- try to gain unauthorised access to the Service, other accounts, or our systems or networks
- overload or disrupt the Service, or introduce viruses or malicious code
- use the Service to build a competing product
Unlicensed use is a breach of these Terms and may infringe our rights. This includes access after termination, unauthorised devices or users, and bypassing licensing.
12. Your content and data
12.1 Ownership. You keep ownership of all data and content you upload to or create in the Service ("Client Content").
12.2 Licence to us. You give us a limited, worldwide, non-exclusive licence to host, store, back up, process, display and make temporary copies of Client Content, as needed to provide and secure the Service. You also give us the right to aggregate and anonymise it under section 12.5. This licence ends when you delete the content or your account ends, subject to section 12.4.
12.3 Your responsibility. You are responsible for the legality and accuracy of Client Content, and for having the right to use it. We do not screen Client Content. We may access or remove content where needed to comply with the law, enforce these Terms or address security risks.
12.4 After cancellation. Your data is kept for up to 90 days after your subscription ends, then permanently deleted. You can ask for earlier deletion when you cancel. Billing records are kept for as long as accounting and tax law requires. Export any data you need before your paid period ends.
12.5 Aggregated and anonymised data. We may aggregate and anonymise Client Content and usage data from across the Service to:
- improve and develop the Service
- produce benchmarks, trend reports and research
Anonymised data cannot identify you, your business or any individual. Once data is anonymised, it is no longer your Client Content and we keep all rights in it. This is part of how the Service works, so you cannot opt out of it. We will not try to re-identify anonymised data. We will not sell or share identifiable Client Content with third parties for their marketing.
13. Data protection
13.1 Roles. For personal data you process using the Service, you are the controller. This includes data about your customers, loyalty members and staff. POSable is your processor under UK data protection law, and your service provider or processor under US state privacy laws.
13.2 Data Processing Agreement. Our Data Processing Agreement applies to that processing and is incorporated into these Terms by reference. You accept it when you accept these Terms. A copy is available on request.
13.3 Your obligations. You must:
- have a lawful basis for your processing
- give your customers and staff the privacy information they need, including for any loyalty scheme
- obtain any required consents
- respond to their rights requests
- notify regulators and individuals of breaches where the law requires it
We will help you as set out in the Data Processing Agreement.
13.4 Our compliance. We comply with applicable data protection laws, including UK GDPR, the Data Protection Act 2018 and applicable US state privacy laws. Our Privacy Policy explains how we handle personal data as a controller, where data is hosted, and the safeguards for international transfers.
13.5 Breaches. We will tell you without undue delay if we become aware of a personal data breach affecting your data.
14. Intellectual property
14.1 We and our licensors own all rights in the Service. This includes software, source code, the dashboard and apps, designs, logos, documentation, trademarks and derivative works.
14.2 While you comply with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your internal business purposes. This includes installing the Android and Windows apps on devices within your plan's allowance.
14.3 If you send us feedback or suggestions, we may use them freely.
14.4 We reserve all rights not expressly granted.
15. Suspension and termination
15.1 We may suspend or end your access immediately if:
- you seriously or repeatedly breach these Terms
- a payment fails
- you abuse the free trial
- your use poses a security, legal or fraud risk
- the law requires it
Where reasonable, we will tell you first and give you a chance to fix the problem.
15.2 When your subscription ends or is terminated:
- your access stops
- your data is handled under section 12.4
- any outstanding fees remain due
Sections that by their nature should survive will continue to apply, including those on content, intellectual property, disclaimers, liability, indemnity and disputes.
16. Warranties and disclaimers
16.1 UK customers. We will provide the Service with reasonable care and skill.
16.2 Disclaimer. Except as stated in section 16.1, and to the fullest extent the law allows, THE SERVICE (INCLUDING AI.MEE FEATURES, OFFLINE MODE AND ANY INTEGRATIONS) IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS. WE MAKE NO OTHER WARRANTIES, CONDITIONS, REPRESENTATIONS OR TERMS, WHETHER EXPRESS, IMPLIED OR STATUTORY. This includes any about satisfactory quality, merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or uninterrupted, secure or error-free operation.
16.3 We do not guarantee that the Service will meet your particular requirements, achieve particular results, or that data will never be lost. We give no warranty for third-party products or services, including payment providers and terminals, AI providers, hardware, networks and integrations.
16.4 US customers. TO THE FULLEST EXTENT PERMITTED BY LAW, POSABLE LLC DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
17. Limitation of liability
17.1 What we do not exclude. Nothing in these Terms limits or excludes liability for:
- death or personal injury caused by negligence
- fraud or fraudulent misrepresentation
- any other liability that cannot lawfully be limited or excluded
17.2 Card processing. As set out in section 7, POSable has no liability for card processing or anything relating to it.
17.3 Excluded losses. Subject to section 17.1, TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE LOSSES OR DAMAGES. We are also not liable for any of the following, whether direct or indirect:
- loss of profits, revenue, sales or business
- business interruption or downtime
- loss of goodwill or reputation
- loss or corruption of data
- the cost of substitute goods or services
- losses caused by payment providers, other third parties, or events beyond our reasonable control
17.4 Cap. Subject to section 17.1, OUR TOTAL AGGREGATE LIABILITY under or in connection with these Terms and the Service is limited to the greater of:
- the subscription fees you paid us in the 3 months before the event giving rise to the claim
- £100 (for UK customers) or US$100 (for US customers)
17.5 These limits apply whatever the legal basis of the claim, including contract, tort (including negligence), breach of statutory duty and misrepresentation. They apply even if we were told such losses were possible, and even if a remedy fails of its essential purpose. They reflect the low price of the Service, and you agree they are reasonable.
18. Indemnity
18.1 You will indemnify and hold POSable harmless against claims, liabilities, damages, costs and reasonable legal fees arising from:
- your use of the Service
- your breach of these Terms or the law
- your Client Content
- your failure to comply with data protection law
- misuse of your account credentials
18.2 You must tell us promptly about any claim. We may take control of its defence, and you must cooperate. You must not settle a claim without our written consent.
19. Force majeure
Neither party is liable for delay or failure caused by events beyond its reasonable control. Examples include natural disasters, war, government action, internet or power outages, cyber attacks, labour disputes and failures of third-party providers. The affected obligations are suspended while the event continues. This does not suspend your obligation to pay fees.
20. Changes to these Terms
20.1 We may update these Terms for legal, regulatory, business or clarity reasons. We will update the "Last updated" date.
20.2 We will give you at least 30 days' notice of material changes, by email, in-app or dashboard notice.
20.3 If you continue to use the Service after the changes take effect, you accept them. If you object, you may terminate your account before the changes take effect, by cancelling in your dashboard and closing your account.
21. Notices
21.1 Notices to you. We may send notices by email, dashboard message or in-app notification, or by posting on our website. Electronic notices meet any legal requirement for notices to be in writing.
21.2 Notices to us. Send notices to:
POSable Ltd
5 Beach Road
Perranporth
Cornwall
TR6 0JL
United Kingdom
Email: tos@posable.co.uk
For US customers, also send notices to:
POSable LLC
30 Gould St, Ste N
Sheridan, WY 82801
USA
Email: tos@posable.co.uk
Notices are treated as received when we acknowledge them.
22. Governing law and disputes
22.1 Informal resolution first. This applies to all customers. Before starting any formal proceedings, the party with the dispute must send a written notice describing it to the other party (to us at the addresses in section 21). Both parties will then try in good faith to resolve the dispute informally for 30 days. Unless your account has been terminated for cause, you can keep using the Service during the dispute, as long as your fees are paid.
22.2 Which rules apply. Sections 22.1 and 22.10 apply to all customers. The rest of the governing law and dispute rules depend on the POSable company you contract with (section 1.2):
- POSable Ltd (UK customers): only section 22.3 applies.
- POSable LLC (US customers): only sections 22.4 to 22.9 apply.
For the avoidance of doubt, only one set of rules applies to each customer, determined by your contracting company. Sections 22.4 to 22.9 (including the arbitration, class action waiver, Wyoming courts and jury waiver) do not apply if you contract with POSable Ltd. Section 22.3 does not apply if you contract with POSable LLC.
22.3 POSable Ltd customers: law and courts. If you contract with POSable Ltd, these Terms and any dispute or claim arising from them, including non-contractual disputes, are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.
22.4 POSable LLC customers: governing law. If you contract with POSable LLC, these Terms and any dispute or claim arising from them are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules, and by the Federal Arbitration Act.
22.5 POSable LLC customers: binding individual arbitration. If you contract with POSable LLC, any dispute, claim or controversy between you and POSable LLC arising from or relating to these Terms or the Service that is not resolved under section 22.1 will be resolved by binding arbitration on an individual basis. The arbitration will be administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
- The seat of arbitration is Wyoming. Hearings may take place remotely or by video.
- A single arbitrator will decide the dispute, and judgment on the award may be entered in any court with jurisdiction.
22.6 POSable LLC customers: exceptions. If you contract with POSable LLC, you or POSable LLC may:
- bring an individual claim in small-claims court, if it qualifies
- seek injunctive or other equitable relief in court to protect intellectual property, confidential information or the security of the Service, or to stop unauthorised use
22.7 POSable LLC customers: class action waiver. If you contract with POSable LLC, disputes between you and POSable LLC will be resolved only on an individual basis. NEITHER YOU NOR POSABLE LLC MAY BRING OR TAKE PART IN A CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE ACTION OR ARBITRATION AGAINST THE OTHER. The arbitrator may not consolidate claims or award relief on a class basis. If this waiver is found unenforceable for a particular claim, that claim must be brought in court under section 22.8, not in arbitration.
22.8 POSable LLC customers: courts. If you contract with POSable LLC, you and POSable LLC submit to the exclusive jurisdiction of the state courts located in Sheridan County, Wyoming, and the United States District Court for the District of Wyoming. This covers claims not subject to arbitration and proceedings to enforce an arbitration award.
22.9 POSable LLC customers: jury trial waiver. If you contract with POSable LLC, TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND POSABLE LLC EACH WAIVE ANY RIGHT TO A JURY TRIAL in any proceeding arising from or relating to these Terms or the Service.
22.10 Rights that cannot be excluded. This applies to all customers. Nothing in these Terms excludes or limits any rights or remedies that cannot lawfully be excluded or limited.
23. General
23.1 Entire agreement. These Terms, together with the documents in section 1.4, are the entire agreement between us. They replace any earlier understandings.
23.2 Severability. If any provision is found invalid or unenforceable, the rest continues in effect. The invalid provision will be changed as little as needed to make it valid.
23.3 Waiver. A failure or delay in enforcing a provision is not a waiver unless confirmed in writing.
23.4 Assignment. You may not assign or transfer your rights or obligations, or your account or licences, without our written consent. We may assign these Terms to an affiliate, including between POSable Ltd and POSable LLC, or as part of a merger, acquisition, reorganisation or asset sale.
23.5 Relationship. The parties are independent contractors. Nothing in these Terms creates a partnership, joint venture, employment, agency or franchise relationship.
23.6 Third-party rights. No one other than you and us has any right to enforce these Terms. If you contract with POSable Ltd, this includes any right under the UK Contracts (Rights of Third Parties) Act 1999.
23.7 Export control and sanctions. You confirm that you are not located in an embargoed country or named on any restricted-party list. You will comply with all applicable export control and sanctions laws, including those of the UK and the US.
23.8 Interpretation. Headings are for convenience only. "Including" means "including without limitation".
